The following terms and conditions apply to all transactions on the www.aCoolDryPlacePhotography.com website. The placing of an order indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference.

These terms and conditions do not affect your statutory rights.

If you have any complaints about our service or any goods or services you purchase from us please contact us using the form on this website.

Purchasing from us:

• To order goods through this website you must be at least 18 years of age.
• We will treat each order for goods as an offer by you to purchase the goods at the price set out in the order, subject to these terms and conditions. By submitting your order you allow us to use your personal details for the purposes of supplying goods.
• We will acknowledge receipt of your order by sending an email to you at the email address you provide in your order form. This does not constitute acceptance of your order.
• We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Receipt of your payment does not automatically constitute acceptance of your order.
• Acceptance of your order will be indicated by your order being marked as processed on your order status page. Our acceptance of your order brings into existence a legally binding contract between us.
• We have the right to refuse at our discretion to supply any goods ordered by you.

Delivery:

• We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. We may deliver the goods in several consignments but will not charge any extra delivery for this. Delivery will be made as soon as possible after your order is accepted.
• You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
• We aim to process & dispatch orders within as quickly as possible. To ensure print quality we ask our processing laboratory to send us your prints, these are then re-packaged prior to sending to you. Consequently, orders may take slightly up to seven days to be dispatched to you. Please allow a period of 14-28 days for delivery in Mainland Britain. For all International orders (all destinations outside of mainland Britain), please allow a period of 21-28 days. Where we anticipate a delay in your order for whatever reason (i.e. a mistake by our laboratory), we will endeavour to contact you by email.
• We will endeavour to process urgent orders promptly if we are informed, on order, of any urgency. However, whilst every reasonable effort shall be made to keep any delivery date, time of delivery shall not be of the essence and we shall not be liable for any losses, costs, damages or expenses incurred by the Customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.

Print likeness to those displayed the web:

• Various factors affect you may percieve images displayed on a website, including your monitor calibration and the room lighting in which you are. These and other factors beyond our control mean that we do not gaurantee that the colours of the printed image will be an exact match to the image as you viewed it.
• If you ordered a print of an image at a different aspect ratio to that displayed on the website, the image will require cropping to fit the aspect ratio of the print. By placing your order, you agree that are decision as to the best crop is correct.

Cancellation, Returns and Refunds:

• Your order can be cancelled at anytime prior to us submitting your order for printing. You do not need to give us any reason for cancelling your contract. Your order will be refunded in full.
• Due to the custom nature of our products, refunds will not be given once your order has been submitted for printing. If you do have any queries please contact us to discuss your options.
• Digital products cannot be refunded once dispatched.

Liability:

• If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us of the problem within 40 days of the date on which you ordered the goods.
• If the goods we deliver are incorrect, damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us of the problem within 10 working days of the delivery of the goods in question.
• If you notify one of the problems above to us, our only obligation will be, at our decision:
  • to make good any shortage or non-delivery;
  • to replace any goods that are damaged or defective; or
  • to refund to you the amount paid by you for the goods in question in whatever way we choose.
• We may also request that incorrect/damaged/defective good are returned to us. The cost of return will be borne by us should the goods prove to be faulty as specified.
• Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.
• You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
• Except as may be implied by law and except in the case of death or personal injury where the Customer is dealing as a consumer, in the event of any breach of these Terms and Conditions by us the remedies to you shall be limited to damages which shall in no circumstances exceed the price of the Goods and we shall under no circumstances be liable for any indirect, incidental or consequential damages.

Force Majeure:

• We will not be under any liability whatsoever in the event that we are prevented or delayed from supplying or making delivery of any Goods by any reason or cause beyond our control.

No Waiver:

• Our failure to insist upon strict performance of any provision of these Terms and Conditions shall not be deemed to be a waiver of our rights or remedies in respect of any present or future default of the Customer in performance or compliance with any of these Terms and Conditions.

Severability:

• In the event that any or any part of these Terms and Conditions shall be determined invalid, unlawful or unenforceable to any extent such term, condition or provision shall be severed from the remaining Terms and Conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

Other information of which you should be aware:

• We may not necessarily keep a copy of these Terms and Conditions and your order. We advise you to print a copy of them for your information in the future.
• Any contract between us shall be governed by English law and the courts of England and Wales shall have non-exclusive jurisdiction over any dispute. All dealings, correspondence and contact between us shall be made or conducted in the English language.
